Overview

Case Number: MU-535349


On April 1, 2026, I submitted a formal complaint to the Maryland Office of the Attorney General Consumer Protection Division regarding records access issues involving the Catonsville Gateway Condominium Association and its management company, American Community Management (ACM).

This complaint relates to ongoing difficulties obtaining association records as provided under Maryland Real Property §11-116.


Background

Since November 13, 2025, I have submitted multiple formal records requests pursuant to Maryland law. These requests have included:

  • Contracts and procurement records
  • Financial records and supporting documentation
  • Meeting minutes and governance records
  • Election records and vote tallies
  • Inspection and enforcement-related documentation

Summary of Issues

Despite repeated requests, complete and timely access to records has not been provided. Issues encountered include:

  • Records not produced within a reasonable timeframe
  • Document links provided but nonfunctional or inaccessible
  • Incomplete productions missing key requested categories
  • Requests submitted through both email and the management portal being closed or left unresolved without fulfillment

Most Recent Request

On April 3, 2026, I submitted a records request related to a violation notice. The request sought basic supporting documentation, including:

  • Inspection records
  • Photographs
  • Related communications

As of the date of the complaint, these records had not been provided.


Additional Access Concerns

In addition to the above, I encountered barriers to accessing records, including:

  • Being informed that access required Board membership
  • Subsequently being denied access to the Board portal despite being an elected Board member

Basis of Complaint

The pattern of responses suggests a failure to comply with Maryland Real Property §11-116, which provides that unit owners are entitled to inspect and copy association records within a reasonable time.


🔍 Requested Resolution

Through this complaint, I respectfully requested that the Consumer Protection Division:

  • Require the Association and ACM to provide the requested records in full
  • Ensure future records requests are handled in compliance with Maryland law
  • Clarify the Association’s obligations regarding record access and response timelines
