📌04.01.2026: Community Update: Records Request Deficiency Notice

On April 1, 2026, I issued a formal deficiency notice after requested records related to a prior architectural violation were not provided.

This request was made under Maryland Real Property §11-116, which gives homeowners the right to access certain Association records.


📄 What’s Outstanding

The following records have not been provided, and no clarification has been given as to whether they exist, are being withheld, or will be produced:

  • Board authorization or meeting minutes related to the violation
  • Inspection reports or documentation supporting the violation
  • Any rules or guidance related to antenna installations (including FCC OTARD protections)
  • Records showing how similar installations have been handled in the community

Providing explanations or partial responses does not replace access to actual records.

Documentation is important to ensure:

  • Decisions are properly authorized
  • Enforcement is consistent
  • Actions are supported by records
